We, EEES Gastro KG, take the protection of your personal data very seriously. Below, we inform you in accordance with the EU General Data Protection Regulation (GDPR/DSGVO) and the Austrian Data Protection Act (DSG) about the nature, scope, and purpose of data processing.

1. Web Hosting and Server Log Files

Our website is self-hosted. When you visit our site, the web server automatically stores certain data in „server log files.“ This includes:

• The visited website (URL)
• The previously visited website (Referrer URL)
• Browser type and version
• Operating system and device type used
• Time of access
• IP address (anonymized or full, depending on configuration)

This data is stored for a maximum of 48 hours and then automatically deleted. Processing is based on our legitimate interest (Art. 6 (1) (f) GDPR) in the technically error-free presentation and security of our website. No data is passed on to third parties.

2. Data Processing for Online Orders (Webshop)

If you place an order for pickup or delivery via our website (WooCommerce), we process the personal data you enter.

• Processed Data: Name, address (for delivery), phone number, email address, ordered products, payment information.
• Purpose & Legal Basis: Processing is necessary for the fulfillment of the sales contract and for the implementation of pre-contractual measures (Art. 6 (1) (b) GDPR). Without this data, we cannot process your order.
• Storage Duration: We store your order data for the duration of the contract processing. Furthermore, under Austrian tax law (Federal Fiscal Code – BAO), we are obliged to retain tax-relevant data (invoices, receipts) for a period of 7 years.
• Transfer: Your data is managed exclusively internally by EEES Gastro KG. No transfer to third parties occurs unless absolutely necessary for contract fulfillment (e.g., to payment service providers).

3. Table Reservations (Online, Phone, Email)

You can reserve tables by phone, email, or via the reservation form on our website.

• Processed Data: To manage your reservation, we process your name, email address (for online/email), phone number (for inquiries), date/time, and number of people.
• Purpose & Legal Basis: Processing is carried out to fulfill a contract or to implement pre-contractual measures (Art. 6 (1) (b) GDPR – Reservation Contract).
• Storage & Deletion: We store this data exclusively for the period necessary to organize and process your reservation. To clarify inquiries or „no-shows,“ data is kept for a few days and irreversibly deleted no later than 7 days after the reservation date, provided there are no statutory retention obligations. Unused reservations will not be invoiced, and data will not be passed on to collection agencies.

4. Newsletter / Weekly Lunch Menu

We offer a service to send you our weekly lunch menu via email (Monday mornings).

• Registration & Mailing: Processing is based on your explicit consent (Art. 6 (1) (a) GDPR). To manage the mailing, we use the service „Send by Elementor“ (Elementor Ltd.), acting as a data processor. By registering, you confirm that you are at least 18 years old. Elementor Ltd. processes your data according to their privacy policy: https://send2.co/privacy-policy/. A Data Processing Agreement (DPA) pursuant to Art. 28 GDPR is in place.
• Withdrawal: You can withdraw your consent at any time. Every email contains an „Unsubscribe“ link. Upon unsubscribing, your email address will be immediately deleted from our distribution list.

5. Cookies

Our website uses cookies. These are small text files stored on your end device.

• Technically Necessary Cookies: For the functionality of the online shopping cart and the reservation widget, we use „session cookies.“ These are technically necessary to assign the ordering or reservation process to the correct user (Legal basis: § 165 (3) TKG 2021 in conjunction with Art. 6 (1) (f) GDPR). These cookies are automatically deleted after closing the browser or within a few days.

6. Your Rights as a Data Subject

Under the GDPR, you generally have the following rights:

• Access: You can request information on whether and which data we process about you (Art. 15 GDPR).
• Rectification: If data is incorrect, you have the right to correction (Art. 16 GDPR).
• Erasure: You can request the deletion of your data, provided no legal retention obligation (e.g., 7 years for invoices) exists (Art. 17 GDPR).
• Restriction & Objection: You can have processing restricted or object to it (Art. 18 & 21 GDPR).
• Data Portability: (Art. 20 GDPR).

7. Right to Lodge a Complaint

If you believe that the processing of your data violates data protection law or your data protection claims have otherwise been violated, you can complain to the supervisory authority.
